MARQUETTE Right of Way Agent (763)682-7386 We have received the preliminary plat for the above mentioned development that consists of a commercial development that would be constructed on the west side of County State Aid Highway (CSAH) 19, just to the south of 53`d Street. We have reviewed the preliminary plat with regard to access and right-of-way issues along CSAH 19 only. Aspects of storm drainage, street improvements, and grading internal to the plat must be reviewed by the City Engineer for conformance to city standards. We offer the following comments: The proposed development will need to maintain existing drainage rates (i.e., the rate at which storm water is discharged from the site must not increase).. The City or project developer will need to submit before/after hydraulic computations for both the 10 and 100 year rainfall events verifying that all existing drainage patterns and systems affecting Wright County Highway right-of-way will be perpetuated. 2. No direct access to County State Aid Highway (CSAH) 19 will be permitted. Access from the proposed commercial development will be to Kyler Avenue NE. All existing field and/or driveway entrances along CSAH 19 within the plat frontage, shall be removed. 4. Consistent with the NE Wright County Transportation Study, a minimum right-of-way dedication of 75 feet from the existing CSAH 19 centerline is required to accommodate the future 4-lane highway. A utility permit will be required for any utility work within the CSAH 19 right-of-way. This will cover any bike path, sanitary, watermain, or storm sewer work within the CSAH 19 right-of-way. The amount to be specially assessed against your particular lot(s), piece(s) or parcel(s) of land are shown on the attached proposed assessment roll. You may at any time prior to certification of assessment to the County Auditor, pay the entire assessment on such property to the City Treasurer with no interest accrued to the date of payment. No interest shall be charged if the entire assessment is paid within 30 days from the adoption of this assessment. You may at any time thereafter pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the next succeeding year. If you decide not to prepay the assessment before the date given above, the rate of interest that will apply is 6.50% per year. The right to partially prepay the assessment has not been authorized by City ordinance. The City is proposing to spread the assessments over a four-year period. The proposed assessment roll is on file for public inspection in the City Clerk's office at City Hall. The total amount of the proposed assessment is $2,007,187.98. Adoption of the proposed assessment by the City Council may be taken at the hearing. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of the assessment unless a written objection, signed by the property owner, is filed with the City Administrator prior to the hearing or presented to the presiding officer at the hearing. An owner may appeal an assessment to the District Court pursuant to Minnesota Statutes Section 429.081 by serving written notice of the appeal upon the Mayor or City Administrator within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or City Administrator. Minnesota Statutes Section 435.193 through 435.195 authorize a municipality to defer the payment of assessments against homestead property owned by persons 65 years of age and older, or who are retired because of permanent and total disability under circumstances where it would be a hardship for such person to make the assessment payments. When deferment of the special assessment has been granted and is terminated for any reason provided in that law, all amounts accumulated plus applicable interest become due. We offer the following comments. 1. A temporary access directly to County State Aid Highway (CSAH) 19 will not be permitted. Due to the level of traffic on this 2-lane highway (approximately 9,000 cars per day), an access at this location, even temporary, would create an unsafe situation for traffic on CSAH 19. 2. Access from CSAH 19 to the proposed development will come via 53`d Street, a City street. A preliminary plat application form, with fee, should be sent to our office for this proposed development.
